Council's Duties

POWERS OF THE LOCAL COUNCIL

ARTICLE. 36 (1) The local council shall have initiative and decide, according to law, on all matters of local interest, except for those established by law in the competence of other local or central public authorities.
(2) The local council shall exercise the following main powers:
a) duties regarding the organization and function of specialty apparatus of the Mayor, of institutions and public services of local interest of companies and autonomous administration of local interest;
b) duties regarding the social - economic development and of environment of the commune, city or municipality;
c) duties regarding the administration of public and private estate of the commune, city or municipality;
d) duties regarding the management of services provided to citizens;
e) duties regarding the inter - institutional cooperation at internal and foreign level;
(3) In exercising the powers provided at paragraph (2) letter a), the local council shall:
a) approve the statute of the commune or town, as well as the organization and functioning regulations of the local council;
b) approve, upon the Mayor's proposal, under the terms of the law, the organization chart, the job title list of the Mayor's specialty apparatus, of the institutions and public services of local interest, as well as the reorganization and job title list of autonomous administrations of local interest;
c) exercise, in the name of territorial-administrative unit, all the rights and duties corresponding to the participation quotes held to companies or autonomous administrations, under the terms of the law.
(4) In exercising the duties provided at paragraph (2) letter b), the local council shall:
a) approve at the Mayor's proposal, the local budget, loans, the credit transfers and the manner of utilization of the budgetary reserve and the closing account of the financial year;
b) approve, upon the Mayor's proposal, the contracting and/or guarantee of loans, as well as contracting the public debt by securities issuances, in the name of territorial - administrative unit, under the terms of the law;
c) establish and approve the taxes and local fees, under the terms of the law;
d) approve, upon the Mayor's proposal, the technical and economic documentations for the investment works of local interest, under the terms of the law;
e) approve the strategies regarding the economic, social and environmental development of administrative - territorial units;
f) ensure the works performance and take the necessary measures for implementation and compliance with the provisions of assumed engagements within the European integration process in the field of environment protection and water management for the services provided to citizens .
(5) In exercising the duties provided at paragraph (2) letter b), the local council shall:
a) decide on the granting of managing, licensing or renting of the public property of the commune or town, as the case may be, as well as of the public services of local interest, under the terms of the law;
b) decide on the sale, license or rent out of the private property of the commune or town, as the case may be, under the terms of the law;
c) approves, under the terms of the law, the arrangement and urban documentation of the territory;
d) assign or change, under the terms of the law, names of the streets, market places, and objectives of local public interest;
(6) In exercising the duties provided at paragraph (2) letter b), the local council shall:
a) ensure, according to its competencies and under the terms of the law, the necessary framework for providing public services of local interest regarding:
1. education;
2. social services for child protection, of disabled persons, elder persons, family and other persons or groups in social need;
3. health;
4. culture;
5. youth;
6. sport;
7. public order;
8. emergency situations;
9. protection and environment restoration;
10. preservation, reconditioning and emphasize of historic and architecture monuments, of parks, public gardens and natural reservations;
11. urban development;
12. person's statistics;
13. bridges and public roads;
14. community services of public utility: water supply, natural gas, sewerage, salubrity, thermal energy, public lightening and local public transport, as the case may be;
15. emergency services of lifeguard type, life guard and first aid;
16. activities of social - community administration;
17. social houses and other locative units that are in the property of administrative - territorial unit or in its administration;
18. emphasize, in the interest of local community, of natural resources in the territory of administrative - territorial unit;
19. other public services established by law;
b) decide the grant of some benefits and other facilities, under the terms of the law, teaching and sanitary staff;
c) support, under the terms of the law, the activity of religious cults;
d) may request information and reports from the Mayor, Deputy mayor and from chiefs of bodies providers of public services, and public utility of local interest;
e) approve the construction of social houses, criteria for social houses allotment and locative utilities in its property or administration;
f) may request information and reports from the Mayor, Deputy mayor and from chiefs of bodies providers of public services, and public utility of local interest;
(7) In exercising the duties provided at paragraph (2) letter b), the local council:
a) decide under the term of the law, on the cooperation or association with Romanian or foreign legal persons in view of jointly financing and performance of certain activities, works, services or projects of local public interest;
b) decide, under the terms of the law, on the twinning of the commune or town with similar territorial - administrative units in other countries;
c) decide, on the cooperation or association with other local administrative units in the country or from abroad, as well as joining national or international associations of local public administration authorities, aimed at the promotion of common interests;
(8) The Local Council can confer to Romanian or foreign physical persons with exceptional merits the title of honor citizen of the commune or town, based on its regulation. By these regulations are also established the terms of withdrawal of the conferred title.
(9) The Local Council fulfills any other duties established by law.
